Terms of Service

1. Introduction and acceptance

These Terms of Service ("Terms") are a binding agreement between you — whether an individual or an entity — and Basil Solutions, ul. Popiełuszki 13, 20-052 Lublin, Poland (VAT 9461073473), which operates the proxy service offered under the Basil Proxies brand ("we", "us", "Basil Proxies"). They govern your access to and use of our residential, mobile, and ISP proxies and everything we provide with them (together, "the Service"), however you reach us — through basilproxies.com, the dashboard at app.basilproxies.com, Discord, email, an authorized reseller, or a direct arrangement.

By creating an account, buying, or otherwise using the Service, you confirm that you have read and accept these Terms, together with our Privacy Policy, Refund Policy, and Service Level Agreement, each of which forms part of this agreement. If you are accepting on behalf of a company or other entity, you confirm that you have authority to bind it. If you don't agree, don't use the Service.

You also confirm that you are at least 18 years old, that you have the legal capacity to enter into this agreement, and that you are not located in, or ordinarily resident in, a country or on a list subject to comprehensive trade sanctions. Using the Service after we post a changed version of these Terms means you accept the change.

2. The Service and its limits

Basil Proxies provides proxy infrastructure — residential, mobile, and ISP proxies, the bandwidth and endpoints that go with them, and the dashboard and tools used to manage them, as made available from time to time. These are neutral technical tools that route network traffic according to your own configuration and instructions.

We are not a publisher, a content intermediary, or a common carrier for the traffic that passes through the Service, and we exercise no editorial control over it. We don't monitor, and we aren't responsible for, the content, purpose, or destination of your traffic.

We don't guarantee that any particular website, platform, or third-party service will be reachable, or will accept or keep accepting traffic routed through the Service. How a third party treats that traffic — whether it blocks, filters, rate-limits, challenges, or detects it — is that third party's decision, is outside our control, and can change at any time. We make no promise that the Service is compatible with, or that your use of it complies with, the terms of any third-party platform. What we do commit to for availability, and for ISP proxies specifically, is set out in the Service Level Agreement.

We don't provide legal, regulatory, or compliance advice. Whether your intended use is lawful and appropriate for your situation is for you to determine, taking your own advice where you need it.

3. Your account

To use the Service you create an account, and you agree to give accurate, current, and complete information and to keep it up to date. Giving false or outdated information is a breach of these Terms and can lead to suspension or termination.

You are responsible for everything that happens under your account, whether or not you authorized it, including anything done by your employees, agents, or anyone who gains access to it. Keep your credentials secure — your password, any API keys, your proxy credentials, and your two-factor methods — and tell us promptly at [email protected] if you believe your account has been accessed without your permission. We recommend a unique, strong password and two-factor authentication where it's offered.

Losing access to your email address, your login, or your recovery methods doesn't entitle you to replacement service, credits, or refunds beyond our normal verification process, and we aren't liable for loss caused by your own failure to keep your credentials safe.

Your account is for your own use. You may not resell, sublicense, or share access to it, except under a separate written agreement with us.

4. Acceptable use

Your use of the Service must comply with these Terms and with every law that applies to you — including where you operate, and where the traffic you send originates, transits, or terminates. You agree not to use the Service, directly or indirectly, and not to let anyone using your account use it, to:

  • Break the law — anything illegal where you operate or where your target is located, including breaches of export controls, sanctions, data-protection, consumer-protection, or anti-spam rules.
  • Commit fraud of any kind.
  • Abuse credentials — credential stuffing, account-takeover attempts, or brute forcing.
  • Send harmful or malicious traffic — spam, phishing, malware, or content that harasses, threatens, or targets others.
  • Attack or overload infrastructure — denial-of-service activity, or scanning or probing networks you don't own or have permission to test.
  • Attempt to gain unauthorized access to any system, account, or data, or to circumvent, defeat, or interfere with a third party's security, authentication, rate-limiting, or access controls.
  • Infringe anyone else's intellectual-property, privacy, or confidentiality rights.
  • Run automation that exceeds what a third-party service permits, in breach of that service's terms or stated limits.
  • Identify, catalog, or publish the IP addresses or ranges we provide.

5. Enforcement

We may investigate suspected breaches of these Terms and take whatever action we reasonably think appropriate — a warning, suspension or termination of your account, withholding a delivery, forfeiting any remaining balance in line with the Refund Policy, reporting the matter to the authorities or to affected third parties, and pursuing any legal remedy available to us.

Using the Service to interfere with a third party's security or access controls is entirely at your own risk. We aren't responsible for any fines, penalties, losses, or claims that result from that, or from your breach of any third party's terms.

6. Verification

To protect the Service against fraud and misuse and to meet our legal obligations, we may ask you to verify your identity or your payment method at any time — for example by providing identification, proof of address, business-registration details, or confirmation of the payment method used. We're more likely to ask where an account is high-volume, resells the Service, or shows unusual or suspicious activity.

If you don't complete a reasonable verification request, we may suspend the Service, hold a delivery, or close the account without a refund. We may also monitor accounts and usage patterns to check compliance with these Terms, and by using the Service you agree to that.

7. Your responsibilities

You are solely responsible for making sure your use of the Service is lawful and appropriate for your purpose, in every jurisdiction that applies to you. That includes doing your own due diligence on the legality of what you intend to do and obtaining any licence or permission you need. We don't give legal advice or any assurance about a particular use.

You keep ownership of, and responsibility for, the traffic and data you send through the Service. We don't routinely monitor or pre-screen it, but we may block or refuse to carry traffic that breaks these Terms or the law, and we may be required by law to preserve or disclose certain information about your use — how we handle that is set out in our Privacy Policy and our Trust & Safety page.

You accept the risks of using proxies to reach third-party services — being blocked, filtered, rate-limited, challenged, geo-restricted, or having a third-party account suspended. None of that is a failure of the Service, and none of it entitles you to a refund or credit.

8. Ordering and delivery

You buy bandwidth or a subscription through checkout. Credentials appear in your dashboard as soon as payment is confirmed, typically in under a minute.

9. Pricing and taxes

Prices are shown in USD, EUR, GBP, or PLN based on your location and charged in that currency. Applicable tax is calculated and added at checkout. You are responsible for any taxes on your use of the Service other than taxes on our income.

10. Plans, renewals, and cancellation

Pay-as-you-go bandwidth is bought in advance and does not expire; it stays on your account until you use it. Subscriptions and ISP proxies renew automatically at the end of each period unless you cancel before the renewal date. Unused residential subscription bandwidth rolls over into the next cycle when the subscription renews, capped at one month's plan allowance; bandwidth above that cap is forfeited at renewal. Rolled-over bandwidth is part of your ordinary balance: it is not refundable, has no cash value, and cannot be transferred. If a subscription is cancelled or otherwise ends, any remaining subscription bandwidth — including rolled-over bandwidth — expires at the end of the paid period. ISP proxies keep the same IP through renewal.

You can cancel a renewing plan at any time from your dashboard. Cancellation stops the next renewal and takes effect at the end of the period you've already paid for; we don't refund the current period. Cancellations and refunds are covered in full by the Refund Policy.

11. IP licensing and availability

The IP addresses we make available are licensed to you for your use during the relevant period — they're licensed, not sold or transferred to you. Depending on your session settings, an IP may rotate or be reassigned, and we don't guarantee the availability of any specific country, city, subnet, or individual IP.

12. Payment and chargebacks

By providing a payment method you authorize us and our payment processor to charge it for the fees due. Fees are payable in advance unless we've agreed otherwise in writing, and you agree to keep your payment details accurate and current.

If you think a charge is wrong, contact us first at [email protected] — a chargeback is not a faster refund. Opening a chargeback against delivered service leads to immediate suspension and forfeiture of any remaining balance, and may lead to a fee and to us refusing future service, as set out in the Refund Policy.

13. Refunds

Refunds, cancellations, and chargebacks are covered in the Refund Policy. In short: pay-as-you-go bandwidth and provisioned ISP proxies are non-refundable, and canceling a subscription stops future renewals without refunding the current period.

If you are a consumer in the EU or UK, you normally have a 14-day right to withdraw from a distance contract. Because the Service is digital content and services supplied immediately, by completing checkout and starting to use the Service you ask us to begin performance right away and acknowledge that you lose that withdrawal right once performance has begun. This doesn't affect any other statutory rights you have that can't be waived.

15. Intellectual property

The Basil Proxies name, the site, the dashboard, our software, documentation, and APIs — and everything we provide with the Service — belong to us or our licensors. These Terms give you only a limited, non-exclusive, non-transferable, revocable licence to use the Service in line with them, and nothing more.

If you send us feedback or suggestions about the Service, we may use them freely and without any obligation to you.

16. Data and privacy

How we handle personal data is set out in our Privacy Policy, which forms part of these Terms. In short: we're the data controller for the account, usage-total, and security data described there; we keep the operational records we need to run the Service, keep it secure, bill correctly, and meet our legal obligations; and we do not log the websites, domains, or destinations you reach through a proxy. What we hold, and how we respond to legal requests, is described in the Privacy Policy and the Trust & Safety page.

17. Warranties and disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent the law allows, we disclaim all warranties that aren't expressly stated in these Terms or the SLA, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will meet your requirements, be uninterrupted or error-free, or be compatible with any particular third-party platform.

You use the Service at your own risk and assume the risks described in these Terms. If you are a consumer, this section does not take away the statutory guarantees you have under the law that applies to you, which can't be excluded.

18. Limitation of liability

To the maximum extent the law allows, we are not liable for indirect, incidental, special, or consequential loss, or for lost profits, revenue, goodwill, or data, arising out of or connected with the Service. We are not responsible for what you do with the proxies we provide — that is your responsibility, including your own compliance with the law and with Acceptable Use.

For any claim related to the Service, our total liability to you is limited to the amount you paid us in the three months before the event giving rise to the claim.

Nothing in these Terms limits liability that can't be limited under the law that applies — including liability for intent or gross negligence, for death or personal injury, or any other liability that the law says can't be excluded.

19. Indemnification

You agree to cover us — Basil Solutions and the people who work with us — against claims, losses, liabilities, and reasonable costs (including legal fees) arising from your use of the Service, your breach of these Terms or the law, your infringement of anyone else's rights, or the activity of anyone using your account. This doesn't apply to the extent a claim results from our own breach, and, if you are a consumer, it applies only to the extent the law allows. This obligation continues after these Terms end.

20. Suspension and termination

We may suspend, restrict, or terminate your account and access to the Service — immediately, and without notice where the situation calls for it — if you breach Acceptable Use, if there's a payment dispute or chargeback, if we reasonably suspect fraud or a security or legal risk, or if your use is unlawful. Suspending or terminating on these grounds forfeits any remaining balance, in line with the Refund Policy.

You can stop using the Service at any time. Canceling a subscription stops future renewals but does not refund the current billing period.

21. Changes to these terms

We may update these Terms from time to time. Changes take effect when we post the new version here with an updated date above. For material changes, we'll try to notify you through the dashboard or by email. Continuing to use the Service after a change takes effect means you accept it.

22. Governing law and disputes

These Terms, and any dispute arising out of them or the Service, are governed by the law of Poland, without regard to its conflict-of-law rules. The courts with jurisdiction over Lublin have exclusive jurisdiction over any dispute — except that, if you are a consumer, nothing here removes the protection of the mandatory laws, or the right to bring proceedings in the competent courts, of the country where you live.

Nothing stops us from seeking an injunction or other urgent relief from any court with jurisdiction to protect our intellectual property, our security, or the integrity of the Service.

23. General

If any part of these Terms is found unenforceable, the rest stays in force and that part is narrowed only as far as needed. Our not enforcing a right isn't a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a merger, sale, or reorganization. Circumstances beyond our reasonable control — for example failures of telecommunications or infrastructure, force majeure events, or acts of authorities — don't count as a breach by us for as long as they last.

These Terms, together with the Privacy Policy, Refund Policy, and Service Level Agreement, are the whole agreement between you and us about the Service and replace any earlier understanding. The sections that by their nature should continue after this agreement ends — including those on acceptable use, intellectual property, disclaimers, liability, indemnification, and disputes — continue to apply.
